1. Definitions

Throughout this terms and conditions, whenever “ChinaCityWalk.com”, “China City Walk”, “us”, “we” or “our” are mentioned, they refer to Shanghai City Walk E-Commerce Co., Ltd. On the other hand, “customer”, “client”, “you” or “your” denote all individuals whose names appear on the booking or ordering form. This includes any individuals added or substituted at a later stage, as relevant.

2. Contractual Foundation

This page details the contractual agreement established between China City Walk and our esteemed customers. Before proceeding with any booking or ordering, it is of utmost importance that you carefully read the following terms and conditions. Ensure that you fully understand their implications, as these terms form the fundamental basis of your contract with Shanghai City Walk E-Commerce Co., Ltd. Do not make any booking or place an order unless you have a comprehensive understanding of our terms and conditions and are willing to be bound by them. When you request us to confirm your booking, we assume that you have meticulously read, fully understood, and consented to be bound by these terms.

These Terms and Conditions are applicable to all forms of bookings and orderings. Whether you interact with our consultants, communicate over the phone, via email, or make online bookings through our website, these terms will govern the transaction.

Once you make a booking, it becomes effective and binding upon your receipt of a Purchase Confirmation. On behalf of all individuals listed in the booking, you hereby undertake the following:

  • Confirm that you have thoroughly read these terms and conditions, possess the authority to agree to them, and indeed agree to be bound by their provisions.
  • Verify that you have fully read the Important Information section specific to the tour package you have purchased and agree to the terms stated therein.
  • Consent to our use of your information in strict accordance with our Privacy Policy.
  • Affirm that you are 18 years of age or older. In cases where there are age restrictions on the booking or ordering, declare that you and all members of your party are of the appropriate age to purchase the services.
  • Assume financial responsibility for the payment of the booking on behalf of all individuals named on the booking or ordering form.

3. Booking, Ordering, and Pricing

ChinaCityWalk.com serves as an online platform for both booking and product ordering, operated by Shanghai City Walk E-Commerce Co., Ltd. The company’s registered head office is located in Shanghai, China.

All bookings and orderings made through ChinaCityWalk.com, regardless of the method employed, are subject to these Terms and Conditions. This includes bookings made through our official website, those processed by our specialists in our Suzhou office, via a ChinaCityWalk.com – contracted travel agency, over the phone, through email, via chat, and any bookings or orderings related to our tour services, special travel arrangements, or products purchased from our online shop.

No contractual obligation exists between the client and ChinaCityWalk.com until ChinaCityWalk.com receives full payment from the client and issues the Purchase Confirmation tax invoice. The client making the booking or ordering accepts these terms and conditions on behalf of all members of the travel or product party and is responsible for ensuring the final full payment is made.

Booking and ordering services through ChinaCityWalk.com are exclusively available to clients who are 18 years of age or older. Minors under 18 years old who wish to use our travel services or engage in online shopping on ChinaCityWalk.com must be accompanied by at least one adult who is 18 years of age or older.

When a client initiates a booking or ordering process on ChinaCityWalk.com, it is considered as the client’s genuine and voluntary act of engaging in online booking or shopping in good faith.

The pricing displayed on the ChinaCityWalk.com website represents a quote based on the basic information provided by the client and completed through our online pricing form. If the client has any special conditions or additional requests, our travel specialist will promptly advise the final tour price via email upon receipt of the client’s written request.

All prices quoted or shown on the ChinaCityWalk.com website are based on current suppliers’ quotations and are subject to change without prior notice. Once the Purchase Confirmation tax invoice has been issued to the client, the booking or product price is guaranteed, except in cases where there is an introduction or increase in taxes or fees by governmental authorities or any other cost increase beyond the control of ChinaCityWalk.com.

If an incorrect price has been posted on the ChinaCityWalk.com website, we reserve the right to cancel, amend, or limit the order placed at the incorrect price.

By submitting a booking or placing a product order, the client acknowledges and warrants compliance with these arrangements.

4. Payments

 

4.1 Full Payment Requirement at Booking/Ordering

For customized itinerary services (with or without online support), as well as any special requirements determined during the itinerary – finalizing process (including, but not limited to, tickets, cruise reservations, train or other transportation bookings, accommodation, and other specific travel arrangements – for which we will issue an additional private booking link), and tour guide services, the client is required to make full payment at the time of booking. This holds true whether the booking is made through the China City Walk website, processed by our office in Suzhou, via a China City Walk – contracted travel agency, or through any other means. Similarly, products in our online shop require full payment at the time of ordering. This is due to the strict terms imposed by our suppliers for certain travel arrangements, such as tickets for cruise, train, or other transportation bookings, accommodation, and other specific travel services.

4.2 Payment Methods

We accept payments through Visa, Master, American Express, or Discover debit and credit cards via secure online payment through PayPal. For payments made via the client’s PayPal account, please note that an additional 3.9% surcharge will be applicable, and this cost shall be borne by the client. Any costs associated with bank transfers shall also be borne by the client.

If a fraud alert is received from our credit card processor, the client must provide written confirmation and declaration before the transaction can proceed. If ChinaCityWalk.com does not receive the required confirmation and declaration from the client, we reserve the right to cancel the booking or order and refund the amount, minus any applicable bank charges, to the Cardholder’s account for security reasons before the tour start date.

5. Alteration

In the event that unforeseen circumstances beyond our control necessitate relevant changes to your travel arrangements or products, we reserve the right to cancel the order or booking, or reschedule departures and itineraries. When we deem it necessary to change related travel arrangements, ChinaCityWalk.com reserves the right to substitute them with arrangements of at least a similar standard without incurring any liability.

We are entitled to make changes to the tour product under the following circumstances:

  • Events or circumstances such as war, fire, epidemics, health risks, typhoon, earthquake, and other actual or potential severe weather conditions occur, which are beyond our control. Under such circumstances, additional fares will be charged if incurred, regardless of the cost.
  • Airline schedules or transportation changes occur beyond the control of ChinaCityWalk.com.
  • There is a supplier shortage, export limitation, policy restriction, or other conditions that prevent the products from being delivered to you.

You may also request an alteration to your tour service. ChinaCityWalk.com will process the alteration free of charge before the booking or ordering is confirmed. All booking alteration requests must be made in writing by the person who made the original booking or ordering request. However, any alterations made after the payment of the deposit will incur a USD50 administration fee. All expenses related to the booking alteration shall be borne by the client, including, but not limited to, all fees and charges incurred by third parties such as airlines and hotels.

For customized itinerary services, we allow a maximum of 5 modifications, regardless of the scale of the modification, based on the versions of the itinerary sent to the client.

6. Cancellation

If you intend to cancel a tour service or product order, you must notify our travel specialist as soon as possible. Contact our travel specialist immediately via the same email you used to communicate with ChinaCityWalk.com or at [email protected].

All cancellation requests should be made in writing via email to ChinaCityWalk.com and will be subject to the following general cancellation charges, calculated from the date the written cancellation request is received:

1. Customized itinerary including online support service

  • Before the first version of the itinerary is sent to you: Full refund
  • After the first version of the itinerary is sent: 100% cancellation fee

2. Tour guide or other travel – related service

  • >=60 days prior to the tour start date: 15% cancellation fee
  • 30 – 59 days prior to the tour start date: 30% cancellation fee
  • 15 – 29 days prior to the tour start date: 50% cancellation fee
  • <=14 days prior to the tour start date: 100% cancellation fee

3. Products in online shop

  • Before shipping: Full refund
  • After shipping: 100% cancellation fee

Any charges applied by third parties (such as airline/cruise/train companies, hotels, other service providers, card fees, bank fees) cannot be waived.

For all cancellations, ChinaCityWalk.com will make every effort to consider your interests. However, late cancellation may result in compensation claims from hotels, cruise operators, and other service providers. In addition to the cancellation fee charged as above, any costs incurred in relation to the booking cancellation, including but not limited to, relevant flights and hotels, will also be charged to your account, if applicable.

If the confirmed tour reservation is cancelled while the tour is in progress, or if any programs are missed due to any act or omission on your part, including but not limited to early departure, late arrival, or cancellation of attractions, unused services cannot be refunded and are not exchangeable.

If you intend to cancel or postpone the service for any reason not attributable to us, our general cancellation terms will apply.

7. Booking/Ordering Confirmation Email

Upon successful payment, you will receive a Booking/Ordering Confirmation Email from our specialist, containing comprehensive details about the Booking Process. It is your responsibility to carefully read this email, as almost all of our tour services require you to submit a Traveller’s Information Form by a specific deadline to finalize the booking. ChinaCityWalk.com will not be liable for any expenses, fines, penalties, costs, or losses incurred as a result of your failure to comply with the Booking Process instructions listed in your Booking Confirmation Email.

The Booking Confirmation Email is valid only for the specified travel dates detailed in your Tour Product. Once this validity period has expired, the Booking Confirmation Email will be considered void and non – refundable in full or in part. We recommend making bookings at least three months in advance. For peak times such as weekends or holiday periods, bookings should be made even further in advance.

We are not responsible for lost or missing Booking Confirmation Emails, for any fraudulent use of the Booking Confirmation Email’s unique reference number, or for any losses caused by your inability to access, print, or download your Booking Confirmation Email. Ensure that our email is not blocked in your junk mailbox.

8. Invoice

All invoices will be sent to you electronically via email.

9. Travel Documents

All travelers must possess a valid passport and the necessary visas or permits prior to the commencement of travel. For international travel, travelers’ passports must have at least six months’ validity from the date of return and at least two blank pages at the time of travel. Obtaining visas, including transit visas and re – entry permits, is the responsibility of the passenger.

You must ensure that you are aware of the passport, visa, health, and other requirements of the country or countries you intend to visit and obtain all relevant documentation prior to travel. Any expenses, fines, penalties, costs, or losses incurred as a result of these documents not meeting the requirements of the relevant authorities will be your sole responsibility.

Our travel specialist may assist you in applying for the necessary travel documentation upon request. However, ChinaCityWalk accepts no responsibility or liability whatsoever for your failure to obtain appropriate travel documentation.

10. Health Requirements

All travelers must be in good physical and mental condition to undertake travel. It is your responsibility to be aware of any health requirements for your travel destination. In some countries, failure to disclose a health condition may result in the country refusing you entry, detaining you, expelling you, or repatriating you. Vaccinations are strongly recommended for certain destinations, and in some cases, vaccination paperwork may be a condition of entry. Note that vaccinations may need to be arranged well in advance of traveling. The client is solely responsible for checking the safety and security conditions, vaccination requirements, and other health requirements of the governments of the countries visited or transited.

Travelers carrying medical or mobility equipment may require a medical certificate. It is the traveler’s responsibility to check any such requirements directly with the airline. Power and/or refrigeration requirements for medical or mobility equipment in some destinations cannot be guaranteed. If medical equipment is required, it is your responsibility to discuss any medical issues with a ChinaCityWalk.com traveler specialist before making a booking. It is also the traveler’s responsibility to ensure that any required batteries are safe and approved for travel, taking into account the particular requirements of airlines and cruise lines.

11. Travel Insurance

We strongly recommend that you obtain comprehensive travel insurance to safeguard yourself against unforeseen circumstances. We also recommend that your policy includes, but is not limited to, cancellation, baggage, theft, personal liability, accident, and medical cover, as well as any other requirements specific to your travel plans.

12. Complaint

If you are dissatisfied with any service provided or being provided by ChinaCityWalk.com, please inform our tour guide or travel specialist within 24 hours after the service. Alternatively, you may write a complaint email to [email protected] within 14 days after the service. Failure to email the complaint to the aforementioned address within the 14 – day period shall be deemed as your election not to pursue the complaint and your agreement to waive any entitlements related thereto, if any. We will handle your complaint with utmost care and provide feedback to you as soon as possible. We will also proactively seek your feedback on our service during and after the tour.

13. Liability

ChinaCityWalk.com shall not be held liable for any loss, damage, accident, injury, sickness, or schedule change due to weather, strike, natural disaster, or any other cause beyond China City Walk’s control.

The travel information published by us is for informational purposes only. It is your responsibility to verify the completeness, accuracy, or otherwise of such information. ChinaCityWalk.com is not responsible for errors, omissions, or inaccuracies in information provided by any third – party suppliers.

The pictures, videos, and information on chinacitywalk.com are collected from the internet. The copyright belongs to the original author. China City Walk shall not be held responsible for any mistakes therein. In the event of any infringement, please inform us immediately.

Customized itineraries are the electronic intellectual property of China City Walk. The client is authorized to use them only for their own travel purposes and must not spread them for any unauthorized use.

ChinaCityWalk.com shall not be responsible for any wrongful, negligent, or fraudulent acts, omissions, changes of itinerary, cancellation, or the failure of any equipment operated by the aforementioned suppliers or any other party not directly owned or controlled by ChinaCityWalk.com.

ChinaCityWalk.com shall not be responsible for your failure to comply with customs regulations.

ChinaCityWalk.com shall not be responsible for the theft or loss of any of your valuables or items of personal property due to your negligence.

ChinaCityWalk.com reserves the right to alter hotels, routes, itineraries, or departure times without prior notice if the necessity arises. In the case of any changes to flights or to scheduled travel by cruise, bus, or train, any additional costs incurred as a result of such changes (such as additional nights at a hotel, meals, transfers) shall be borne by you. Therefore, we strongly recommend that you obtain and maintain comprehensive travel insurance to cover all contingencies.

All information on ChinaTours.com’s website is subject to change. ChinaCityWalk.com reserves the right to alter, change, or correct any mistakes that may appear on the website or in the published price lists.

ChinaCityWalk.com reserves the right to modify or rescind these terms and conditions in whole or in part at any time, with or without notice, without incurring any liability.

14. Privacy Policy

At China City Walk, our unwavering commitment is to provide you with a worry – free trip in China and other countries where we offer tour packages. We firmly believe in safeguarding your privacy. That is why we only collect information relevant to the services we provide. If you submit personal information to us via telephone, website, mail, fax, e – mail, or any other means, it is used solely to arrange your trip in China and will never be sold, rented, shared, or passed on to any unauthorized third party. 15. Governing Law and Dispute Resolution

These terms and conditions shall be governed and interpreted in accordance with the laws of the People’s Republic of China, excluding the provisions of conflict rules.
